These Terms of Service (“Terms”) govern the services provided by THE·THREE·13 (“we”, “us”, “our”) and your use of thethree13.com. By engaging our services or using this site, you agree to these Terms. Questions? hello@thethree13.com.

1. Services

We provide website design and development services, including one-time website builds, ongoing care/maintenance plans, and website subscriptions. The specific deliverables, scope, and price for your project are confirmed in a written quote or proposal before work begins.

2. Quotes & project scope

• Quotes are valid for 30 days unless stated otherwise.
• Work covers the scope agreed in the quote. Additional requests beyond that scope are quoted and billed separately.
• Pricing shown on this site is a starting point; final pricing depends on your requirements.

3. Payments & billing

• One-time projects: typically require a deposit to begin, with the balance due before launch or as set out in the quote.
• Care plans: billed monthly in advance. Included edit time is per month and does not roll over to the next month.
• Website Subscription: $0 upfront, billed monthly in advance, with a 12-month minimum term. After the minimum term it continues month-to-month until cancelled.
• All prices are in USD and exclude third-party costs (domain, premium plugins/apps, stock assets, payment processing).
• Late or failed payments may result in suspension of services after reasonable notice.

4. Cancellation & refunds

• Care plans may be cancelled at any time with 30 days’ notice.
• Website Subscription: cannot be cancelled during the 12-month minimum term except for cause; after the minimum term, cancel any time with 30 days’ notice.
• Cancelling a subscription without exercising the buyout ends our hosting of that site, and the site will be taken offline.
• Deposits and fees for work already performed are non-refundable. Monthly fees already paid are non-refundable.

5. Ownership & intellectual property

• One-time builds: on full payment, ownership of the final delivered website transfers to you.
• Website Subscription: while subscribed, the website is hosted and managed by us and licensed to you for the subscription term. You may buy out and fully own the site at any time for a one-time fee agreed in your quote.
• Third-party assets (fonts, plugins, stock media, libraries) remain subject to their own licenses.
• We may display completed work in our portfolio and marketing unless you request otherwise in writing.

6. Your responsibilities

• Provide content, materials, and feedback in a timely manner so work can progress.
• Ensure you have the rights to any text, images, or materials you supply to us.
• Provide accurate contact and billing information.

7. Third-party services

Our services rely on third parties (e.g., hosting providers, domain registrars, form processing, and analytics). We are not responsible for outages, changes, or actions of those providers, though we will make reasonable efforts to assist.

8. Support & availability

Support is provided during business hours, Monday–Friday. Response times stated in our plans are targets, not guarantees, and do not constitute 24/7 emergency cover unless separately agreed in writing.

9. Warranties & disclaimer

Services are provided on a commercially reasonable, “as is” basis. We do not guarantee specific outcomes such as search rankings, traffic volumes, conversions, or sales. We are not responsible for issues caused by third-party platforms, client-supplied materials, or changes made by others after delivery.

10. Limitation of liability

To the maximum extent permitted by law, our total liability arising from the services is limited to the amount you paid us for the services giving rise to the claim in the preceding three (3) months. We are not liable for indirect, incidental, or consequential damages.

11. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the latest version. Continued use of our services after changes constitutes acceptance.

12. Governing law

These Terms are governed by the laws applicable where THE·THREE·13 operates, without regard to conflict-of-law principles. Any disputes will be handled in the competent courts of that jurisdiction.
